PREMISE
Webtier Srl (hereinafter Webtier), with registered office in Rome, in via Simone Martini n. 135, has drawn up, in a simple and comprehensible way, this document, regarding the processing of personal data.
By processing of personal data we mean any operation or set of operations, carried out with or without the aid of electronic instruments, concerning the collection, recording, organisation, conservation, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, cancellation and destruction of data, even if not recorded in a database.
This information is aimed at users registered on the website www.webtier.cloud and to users who purchase our services.
The information and data provided will be processed in compliance with the relevant rules and regulations in force (including, by way of example but not limited to, the General Data Protection Regulation – EU Regulation 2016/679 – General Data Protection Regulation or “GDPR”) .
The data processing carried out by WEBTIER will be based on the principles of correctness, lawfulness, transparency, accuracy, integrity, confidentiality, limitation of purposes and storage and data minimization.
WHO IS THE DATA CONTROLLER OF PERSONAL DATA
The Data Controller of the processing carried out through the site is WEBTIER. The appointed DPO (Data Protection Officer or in Italian Personal Data Protection Officer) can be contacted at the following address rpd@webtier.cloud for all information relating to the processing of personal data.
THE LEGAL BASES OF THE PROCESSING OF YOUR PERSONAL DATA
WEBTIER bases the processing of personal data on various legal bases:
- consent (only when necessary or permitted by law), expressed clearly and unequivocally and always revocable.
- the establishment of a contractual relationship and the fulfillment of the obligations arising from it;
- the need to comply with applicable laws and to establish, exercise or defend against legal claims;
- the need to respond to requests from users;
- any other legal basis permitted by current regulations.
WHAT TYPE OF PERSONAL DATA WE PROCESS, FOR WHAT PURPOSE AND FOR HOW LONG WE KEEP THEM
- Browsing data
For the correct functioning of the WebTier site and the services provided, IT systems and software procedures are necessary which, during their normal operation, acquire some personal data, the transmission of which is implicit in the use of internet communication protocols. This is data that is not collected to be associated with identified subjects, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified (e.g. IP addresses). These data are used only for anonymous statistical information relating to the use of the service and to verify its correct functioning and are kept for the period strictly necessary and in any case in compliance with current regulations.
2. Personal data of registered users
In order to allow the provision of the services provided for in the contractual agreements and the performance of marketing activities, WEBTIER will collect the following data relating to customers: Name – Surname – Username – Password – Email addresses. Such data will be retained for the purposes of providing the services, as well as for promotional activities and for the duration of 10 years from the termination of the contractual relationship. For tax purposes and for other obligations required by law, the same data will be retained for 10 years, unless the law allows a longer retention period, also due to the maturing of the prescription of any rights claimed by third parties.
3. Data of third parties provided by the interested party
It may happen that the user provides the data of third parties to request the assignment of domain names. In this circumstance the registered user will be the exclusive owner of the processing of the aforementioned data with related legal obligations and responsibilities. Such data will be stored exclusively for fiscal purposes (invoicing) for a period of 10 years and for a period of 6 months starting from the cancellation of the domain name to which they refer (domain registration for third parties), unless the law imposes or allows for a longer shelf life.
4. Cookies
Access to the site www.webtier.cloud may involve the sending, by our servers to the user's PC, of so-called "cookies", i.e. files that allow information on the pages visited to be obtained in order to speed up the use of the various services. The use of cookies is limited to the duration of the single session and does not in any way allow the acquisition of personal identification data of the user. The acquired data will not be stored but will be deleted when the browser is closed. You can choose to disable cookies at any time by simply changing your browser settings; We remind you, however, that deactivating cookies may slow down or prevent access to some sections of the site. HOW WE MANAGE YOUR DATA FOR PROMOTIONAL PURPOSES
WEBTIER may send you marketing communications via email regarding its services, products, promotions or events.
These communications may also be personalized taking into account your preferences (expressly indicated by you or inferred from visits to the WebTier site or based on links you clicked). Before starting any marketing activity and if required by applicable laws, we will ask you to provide us with your consent, which you can however revoke by sending an email to rpd@webtier.cloud. Even if you revoke your consent to receiving marketing communications, you may still receive other types of communications (for example, important technical or administrative notices).
WHO ARE THE RECIPIENTS OF THE PERSONAL DATA
The recipients of the personal data collected are:
- people, companies, professional firms that provide consultancy services;
- subjects who provide services related to the collection of payments (for example bank transfer, credit card);
- any subjects who carry out maintenance activities on network equipment and communication networks;
- other bodies or authorities to which, for reasons or legal obligations, it is necessary to communicate your personal data;
- persons authorised by WEBTIER to carry out activities necessary for the provision of services (with legal obligation of confidentiality).

TRANSFER OF PERSONAL DATA
In order to be able to provide some services regulated in the contract, some of your data may be transferred outside the European Economic Area.
In the aforementioned circumstances, the companies receiving the data guarantee us standards of protection, thanks to appropriate technical, organizational and legal measures.
WHAT RIGHTS CAN YOU EXERCISE
Among the rights exercisable by users of the site who have provided their personal data for the purposes described above, provided that the conditions provided for by the legislation from time to time are met (in particular, articles 15 and following of the Regulation), there are:
- the right to know whether the Data Controller is processing personal data concerning them and, in this case, to have access to the data being processed and all the information relating to it;
- the right to rectify inaccurate personal data concerning them and/or to integrate incomplete personal data;
- the right to erasure of personal data concerning them;
- the right to limit processing;
- the right to object to processing;
- the right to portability of personal data concerning them.
In any case, the interested party has the right to submit a formal Complaint to the Guarantor Authority for the protection of personal data, according to the methods available on the Guarantor's website.
CHANGES TO THE PRIVACY POLICY
WEBTIER may modify or update the content of this information.
